Conclusion of CCAA Proceedings

As a result of receiving confirmation from Canada Revenue Agency ("CRA") that CRA had issued the anticpated Notices of Reassessment, on October 28, 2011, Fortress Energy Inc. ("Fortress" or the "Company") made application to the Court of Queen's Bench of Alberta (the "Court") for an order (the "Discharge Order") discharging the Company from the proceedings under the Companies’ Creditors Arrangement Act (the “CCAA”).  Hardie & Kelly Inc. was discharged as the monitor (the "Monitor") under the proceedings concurrent with the granting of the Discharge Order. 

CCAA Proceedings

On March 2, 2011, Fortress made an application for protection under the CCAA and an order (the “Initial Order”) was granted by the Court.  The Initial Order provided certain relief including the imposition of a Stay of Proceedings (the “Stay”) against the Company and its assets through to March 31, 2011.  Several extension of the Stay were granted over the course of the proceedings in advance of the Company being discharged from the proceedings on October 28, 2011.
